THE LEGISLATION
The Land Assembly Project Area Act is a law that gives landowners a clearer process when government buys land for long-term, large scale transportation projects like ring roads or water reservoirs.
WHAT ALBERTANS HAVE SAID
Four main concerns were expressed by some Albertans about the legislation.
- Confusion about what kinds of projects fall under this Act.
- Concerns about whether Albertans get fair compensation and access to the Expropriation Act.
- Concerns about access to the courts, both in terms of compensation and enforcement orders.
- Concerns about penalties under the Act.
CHANGES
On December 6th, amendments to the Act were passed in the Legislature to address each of these four areas as follows:
- Landowners now have the option to trigger expropriation of their land.
- It is more clear that landowners have the option to sell their land to government and then lease it back until the infrastructure project begins.
- There is a clearer explanation of the types of major transportation or water projects under the Act.
- It is clear that this legislation does not override the Expropriation Act.
- Any suggestion that an Albertan could receive a jail sentence for violating the Act has been removed.
- Enhanced access to the Courts.
