The Land Assembly Project Area Act is a law that gives landowners a clearer process when government buys land for long-term, large scale transportation projects like ring roads or water reservoirs.

WHAT ALBERTANS HAVE SAID

Four main concerns were expressed by some Albertans about the legislation.

  1. Confusion about what kinds of projects fall under this Act.
  2. Concerns about whether Albertans get fair compensation and access to the Expropriation Act.
  3. Concerns about access to the courts, both in terms of compensation and enforcement orders.
  4. Concerns about penalties under the Act.

CHANGES

On December 6th, amendments to the Act were passed in the Legislature to address each of these four areas as follows:

  • Landowners now have the option to trigger expropriation of their land.
  • It is more clear that landowners have the option to sell their land to government and then lease it back until the infrastructure project begins.
  • There is a clearer explanation of the types of major transportation or water projects under the Act.
  • It is clear that this legislation does not override the Expropriation Act.
  • Any suggestion that an Albertan could receive a jail sentence for violating the Act has been removed.
  • Enhanced access to the Courts.
